The substantial austerity programmes being deployed in Europe have created heightened awareness of supporting fiscal measures, with some recent initiatives designed to subject offshore structures to a greater tax burden.

In parallel the confusion and conflation of tax planning, tax avoidance and tax evasion are serving to create heightened tensions and uncertainty around legitimate planning which is invariably directed at solving succession and asset protection issues, but which nonetheless requires a degree of tax certainty. The political landscape is moving advisers inexorably into uncharted territory, posing considerable challenges in advising clients in the face of either discriminatory or retrospective measures being introduced at an ever-increasing rate.
